Newly Obtained FBI Records Call Defense Department’s Methods "Torture," Express Concerns Over "Cover-Up" That May Leave FBI "Holding the Bag" for Abuses
NEW YORK -- A document released for the first time today by the American Civil Liberties Union suggests that President Bush issued an Executive Order authorizing the use of inhumane interrogation methods against detainees in Iraq. Also released by the ACLU today are a slew of other records including a December 2003 FBI e-mail that characterizes methods used by the Defense Department as "torture" and a June 2004 "Urgent Report" to the Director of the FBI that raises concerns that abuse of detainees is being covered up.
"These documents raise grave questions about where the blame for widespread detainee abuse ultimately rests," said ACLU Executive Director Anthony D. Romero. "Top government officials can no longer hide from public scrutiny by pointing the finger at a few low-ranking soldiers."
The documents were obtained after the ACLU and other public interest organizations filed a lawsuit against the government for failing to respond to a Freedom of Information Act request.
The two-page e-mail that references an Executive Order states that the President directly authorized interrogation techniques including sleep deprivation, stress positions, the use of military dogs, and "sensory deprivation through the use of hoods, etc." The ACLU is urging the White House to confirm or deny the existence of such an order and immediately to release the order if it exists. The FBI e-mail, which was sent in May 2004 from "On Scene Commander--Baghdad" to a handful of senior FBI officials, notes that the FBI has prohibited its agents from employing the techniques that the President is said to have authorized.
Another e-mail, dated December 2003, describes an incident in which Defense Department interrogators at Guantánamo Bay impersonated FBI agents while using "torture techniques" against a detainee. The e-mail concludes "If this detainee is ever released or his story made public in any way, DOD interrogators will not be held accountable because these torture techniques were done [sic] the ‘FBI’ interrogators. The FBI will [sic] left holding the bag before the public."
The document also says that no "intelligence of a threat neutralization nature" was garnered by the "FBI" interrogation, and that the FBI’s Criminal Investigation Task Force (CITF) believes that the Defense Department’s actions have destroyed any chance of prosecuting the detainee. The e-mail’s author writes that he or she is documenting the incident "in order to protect the FBI."
"The methods that the Defense Department has adopted are illegal, immoral, and counterproductive," said ACLU staff attorney Jameel Jaffer. "It is astounding that these methods appear to have been adopted as a matter of policy by the highest levels of government."
The June 2004 "Urgent Report" addressed to the FBI Director is heavily redacted. The legible portions of the document appear to describe an account given to the FBI’s Sacramento Field Office by an FBI agent who had "observed numerous physical abuse incidents of Iraqi civilian detainees," including "strangulation, beatings, [and] placement of lit cigarettes into the detainees ear openings." The document states that "[redacted] was providing this account to the FBI based on his knowledge that [redacted] were engaged in a cover-up of these abuses."
The release of these documents follows a federal court order that directed government agencies to comply with a year-old request under the Freedom of Information Act filed by the ACLU, the Center for Constitutional Rights, Physicians for Human Rights, Veterans for Common Sense and Veterans for Peace. The New York Civil Liberties Union is co-counsel in the case.
Other documents released by the ACLU today include:
* An FBI email regarding DOD personnel impersonating FBI officials during interrogations. The e-mail refers to a "ruse" and notes that "all of those [techniques] used in these scenarios" were approved by the Deputy Secretary of Defense. (Jan. 21, 2004)
* Another FBI agent’s account of interrogations at Guantánamo in which detainees were shackled hand and foot in a fetal position on the floor. The agent states that the detainees were kept in that position for 18 to 24 hours at a time and most had "urinated or defacated [sic]" on themselves. On one occasion, the agent reports having seen a detainee left in an unventilated, non-air conditioned room at a temperature "probably well over a hundred degrees." The agent notes: "The detainee was almost unconscious on the floor, with a pile of hair next to him. He had apparently been literally pulling his own hair out throughout the night." (Aug. 2, 2004)
* An e-mail stating that an Army lawyer "worked hard to cwrite [sic] a legal justification for the type of interrogations they (the Army) want to conduct" at Guantánamo Bay. (Dec. 9, 2002)
* An e-mail noting the initiation of an FBI investigation into the alleged rape of a juvenile male detainee at Abu Ghraib prison in Iraq. (July 28, 2004)
* An FBI agent’s account of an interrogation at Guantánamo - an interrogation apparently conducted by Defense Department personnel - in which a detainee was wrapped in an Israeli flag and bombarded with loud music and strobe lights. (July 30, 2004)
The ACLU and its allies are scheduled to go to court again this afternoon, where they will seek an order compelling the CIA to turn over records related to an internal investigation into detainee abuse. Although the ACLU has received more than 9,000 documents from other agencies, the CIA refuses to confirm or deny even the existence of many of the records that the ACLU and other plaintiffs have requested. The CIA is reported to have been involved in abusing detainees in Iraq and at secret CIA detention facilities around the globe.
The lawsuit is being handled by Lawrence Lustberg and Megan Lewis of the New Jersey-based law firm Gibbons, Del Deo, Dolan, Griffinger & Vecchione, P.C. Other attorneys in the case are Jaffer, Amrit Singh and Judy Rabinovitz of the ACLU; Art Eisenberg and Beth Haroules of the NYCLU; and Barbara Olshansky and Jeff Fogel of CCR.

There is a cancer growing wildly deep within the blood-red belly of America as the vestiges of decency and compassion disappear and the swelling stink of profit over people gains sway over the undernourished enfeebled nebbishes. Why Florida Won't Play Fair on Election Day

After the debacle in Florida four years ago, former president Gerald Ford and I were asked to lead a blue-ribbon commission to recommend changes in the American electoral process. After months of concerted effort by a dedicated and bipartisan group of experts, we presented unanimous recommendations to the president and Congress. The government responded with the Help America Vote Act of October 2002. Unfortunately, however, many of the act’s key provisions have not been implemented because of inadequate funding or political disputes.
The disturbing fact is that a repetition of the problems of 2000 now seems likely, even as many other nations are conducting elections that are internationally certified to be transparent, honest and fair.
The Carter Centre has monitored more than 50 elections, all of them held under contentious, troubled or dangerous conditions. When I describe these activities, either in the US or in foreign forums, the almost inevitable questions are “Why don’t you observe the election in Florida?” and “How do you explain the serious problems with elections there?”
The answer to the first question is that we can monitor only about five elections each year, and meeting crucial needs in other nations is our top priority. (Our most recent ones were in Venezuela and Indonesia, and the next will be in Mozambique.) A partial answer to the other question is that some basic international requirements for a fair election are missing in Florida.
The most significant of these are:
- A non-partisan electoral commission or a trusted and non-partisan official who will be responsible for organising and conducting the electoral process before, during and after the actual voting takes place. Although rarely perfect in their objectivity, such top administrators are at least subject to public scrutiny and responsible for the integrity of their decisions. Florida voting officials have proved to be highly partisan, brazenly violating a basic need for an unbiased and universally trusted authority to manage all elements of the electoral process.
- Uniformity in voting procedures, so that all citizens, regardless of their social or financial status, have equal assurance that their votes are cast in the same way and will be tabulated with equal accuracy. Modern technology is already in use that makes electronic voting possible, with accurate and almost immediate tabulation and with paper ballot printouts so all voters can have confidence in the integrity of the process. There is no reason these proven techniques, used overseas and in some US states, could not be used in Florida.
It was obvious that in 2000 these basic standards were not met in Florida, and there are disturbing signs that once again, as we prepare for a presidential election, some of the state’s leading officials hold strong political biases that prevent necessary reforms.
Four years ago, the top election official, the Florida secretary of state, Katherine Harris, was also the co-chair of the Bush-Cheney state campaign committee. The same strong bias has become evident in her successor, Glenda Hood, who was a highly partisan elector for George Bush in 2000. Several thousand ballots of African Americans were thrown out on technicalities in 2000, and a fumbling attempt has been made recently to disqualify 22,000 African Americans (likely Democrats), but only 61 Hispanics (likely Republicans), as alleged felons.
The top election official has also played a leading role in qualifying Ralph Nader as a candidate, knowing that two-thirds of his votes in the previous election came at the expense of Al Gore. She ordered Nader’s name be included on absentee ballots even before the state supreme court ruled on the controversial issue.
Florida’s governor, Jeb Bush, naturally a strong supporter of his brother, has taken no steps to correct these departures from principles of fair and equal treatment or to prevent them in the future.
It is unconscionable to perpetuate fraudulent or biased electoral practices in any nation. It is especially objectionable among us Americans, who have prided ourselves on setting a global example for pure democracy. With reforms unlikely at this late stage of the election, perhaps the only recourse will be to focus maximum public scrutiny on the suspicious process in Florida.

2. Physical. We talked about him getting his flight physical situation fixed before his date. Says he will do that in Alabama if he stays in a flight status. He has this campaign to do and other things that will follow and may not have the time. (No time for America's War in Viet Nam, had better things to do like 5-time dodger Dick Cheney) I advised him of our investment in him and his commitment. He's been working with staff to come up with options and identified a unit that may accept him. I told him I had to have written acceptance before he would be transferred, but think he's also talking to someone upstairs. (God, or Mom and Dad?)

Suspension of Flight status
1. On this date I ordered that 1st Lt. Bush be suspended from flight status due to failure to perform to USAF/TexANG standards and failure to meet annual physical examination (flight) as ordered.
2. I conveyed my verbal orders to commander; 147th Ftr Intrcp Gp with request for orders for suspension and convening of a flight review board IAW AFM 35-13.
3. I recommended transfer of this officer to the 9921st Air Reserve Squadron in May and forwarded his AF Form 1288 to 147th Ftr Intrcp Gp headquarters. The transfer was not allowed. Officer has made no attempt to meet his training certification or flight physical. Officer expresses desire to transfer out of state including assignment to non-flying billets.
4. On recommendation of Harris, I also suggested that we fill this critical billet with a more seasoned pilot from the list of qualified Vietnam pilots that have rotated. Recommendations were received but not confirmed.

Republicans Kill for Sport
Republicans are SPORT KILLERS not maggots (larval flies). Flies feed
upon the dead while Republicans feed on the living. It's only when
the living resist that the Republicans will kill them and eat them.
For the most part Republicans kill for the pleasure of seeing another
living creature die at their whim. They kill for sport. They torture
those who resist when there is enough time to sit and enjoy the
suffering. Torture killings are especially appealing to Republicans
like the President (blowing up frogs in his late teens) and the
Secretary of Defense.(blowing up thousands of innocent people all over
the world while ensuring the starvation of several million others
from his early 50's to early 70's). A lifetime of sport killing goes
to show you that some people never quite get that human being thing
quite right. If Bush has his way and is not stopped this killing will
go on until mid-century.
moving on....Republicans make guns in their factories and they give
them to police and other irresponsible types like 16-17-year-old
unemployed hicks from the Red States and they go on shooting rampages.
Some just kill their wives. Some just kill their kids. Some just
kill others' neighbors kids and dogs and cats. Sport Killers!
All Republicans are proud of their ability to kill completely
defenseless animals in the woods, or in their back yards. When they
have "controlled the local population" with death and they STILL need
to KILL FOR SPORT they force the US tax paying population to buy more
guns and bigger guns and tanks and bombers and then they have their
leader send other people's kids to foreign countries to kill even more
people and animals so that that they can sit back in their cozy gated
community to watch the carnage on their 180 channel dish network TV.
It's easier when you don't see the screams of prolonged agony and gut
wrenching reality of teeth, hair, and eyeballs staring up at you from
the blood soaked pavement. Don't want YOUR kids to see that do you
sport killing Republicanistas?
Republicans don't want to see the face of their enemy so when they are
illegally killing in Iraq they often turn TV cameras away from the
faces or point them to a piece of shrapnel on the ground rather than
the blown apart bleeding bodyhalf in the street. What's worse: a head
and shoulders without a chest; or two legs without a stomach, or the
hindquarters of a cat or a pig or a dog or a baby? Republicans just
want to cheer the "hit" and then take the injured off the field of
battle, shoot 'em up with drugs and get them back on the field of war
to continue the game.
When I think of Republicans I think of the gun/pawn shop scene in
"Pulp Fiction"... where the employee bags a Black man, calls the
owner who arrives in his little nazi uniform and they both go to the
back room, where the employee buggers the Black man while the owner
sits there masturbating and working himself into a sweat. This is
what the Republicans do with our GI's. They send other people's
children to bugger whole countries and sit home and masturbate in
front of their TV's...switching back and forth between the Playboy
Channel and Al Jazeera. What's ironic is that sleazeball Republicans
in Israel and Egypt and Iran are doing the same thing as the US
Republicans. Even worse, just like in "Pulp Fiction", is that when
the Republicans get their nut and relax into complete flaccidity
(never more than 5 minutes), they call their kids back into the room
and send in a Republican actor like Bruce Willis (or Arnold
Schwarzenegger, or John Wayne, or Clint Eastwood) who miraculously
breaks his bonds, grabs a Samauri sword and saves the Black man in
order to get the Black and Asian vote.

Bush to Bring War Home: Troops to Fight Americans
The recent Bush move to bring an armored division and an infantry division from Europe back to provide security in the United States smells really bad. Think about it, TANKS and TROOPS to protect us from Mexico and Canada?
These troops and tanks are supposed to be part of a larger redeployment but the entire operation may be just a charade for the purpose of getting troops and tanks into the streets of American cities to quell the inevitable riots that would surely erupt if Bush is handed another dirty election victory through the combined influences of rigged machines, phony voter purge lists and the orchestrated state police intimidation techniques which are being used in Florida right now.
When in the same cities, John Kerry is outdrawing Bush by 20 to 1. 40,000 to 2,000 here on the West Coast over the weekend. Americans throughout the United States who protest another Bush jury-rigged election will face the same force being used in Najaf, Iraq; --because America is the real apple for the Bush swelling stink.
The rest of the world in comparison to the United States pales in actual and latent industrial strength. We have a work force which is seriously out of work. People are wandering the streets homeless, very hungry, and very sick. Our soldiers throughout the world in US military bases hear the daily drumbeat of Limbaugh banging on their heads that American Liberals are in league with the 'enemies' the Bush swelling stink is engaging overseas.
Bush has decided that by bringing troops and tanks home and by pushing and promoting fraudulent policies and crooked elections he can produce a real war right here in the United States. The benefits are huge. With a captive workforce and an army without any serious logistical problems where feeding the troops is only as difficult as raiding the local supermarket shelves, the betting is that the American working class can be had very cheaply.
Our society may soon achieve complete militarization just like 1917 in Petrograd. Troops will open fire with real bullets when the popular rage against the Bush swelling stink hits critical mass and pours out into the streets of America. The question is, "Will the US troops mutiny and resign as the Russians did in 1917?" , or, "Will the brainwashing be complete and the troops turn to enslave their own neighbors and countrymen?"
For people who have the misfortune to meet returnees from the Afghanistan and Iraq Wars the answer is not clear. The widespread acceptance of torture by American troops in Afghanistan, Cuba, and Iraq, coupled with killing injured enemy combatants and the slaughter of innocents through massive bombing, clouds the picture of who Johnny actually has become when he comes marching home. There is a real danger here of training a warrior class which will feel the same disregard for their neighbors and countrymen as they were taught in Iraq. The sick and heartless management of this war in the middle east has thoroughly crazed the participants. The suicide rate among US troops has been astounding. The main cause of the suicides has been the double think which has been forced upon the enlisted men and women where they are commanded to do things contrary to their nature.
There have been highly publicized opponents of the Bush swelling stink within the rank and file of the US military machine. Members of the rank and file are drawn from the economically disadvantaged, dispirited, and deluded who wake up realizing that the Bush swelling stink was using them to conquer the world for itself, not for the benefit of the masses of struggling Americans but, for the Orcs of the ruling aristocrat class called Republicans. And this is where the shiver comes on strong, because the officer and commander class of the US military machine is overwhelmingly Republican, bent upon holding its unearned privilege and dominion over the "unwashed and useless eaters" of the vast American majority who feel first hand the effects of the Bush swelling stink.
It comes down to this. There are not enough fighting, voting age Republicans within the United States to defeat a thoroughly aroused and raging angry American population. People who identify as Republicans and vote are only about 18 percent of the entire population of the country.
When that Republican line officer of yours comes home singing, "Yankee Doodle Dandy", take him aside and straighten him/her out. Tell them what the president did to America while he/she was away killing for George's booty.
